    MINUTE ORDER IN CHAMBERS by Judge S. James Otero: This matter is before the Court on its own initiative. The Court has reviewed the FIRST AMENDED COMPLAINT 59 and finds it to be confusing, distracting, ambiguous, and unintelligible. Within 21 days of this Order, Relator may file a Second Amended Complaint. Alternatively, she may request a voluntary dismissal of this case, pursuant to Federal Rule of Civil Procedure 41(a). If she chooses to file a Second Amended Complaint, it may only be brought against DaVita and TRC, and must (1) clearly identify the specific Medicare regulations allegedly violated by Defendants' conduct; (2) describe the conduct constituting such alleged violations with the particularly required under Rule 9(b); and (3) be organized in a logical manner using comprehensible language. The Court will not entertain a Second Amended Complaint that includes block quotations from legal authorities--instead, Relator must specify the particular regulations at issue and describe in basic English why Defendants' conduct violates these regulations. James Otero: The Court is in receipt of Nasrin Morrowatti's ("Counsel") ex parte application seeking both a one-week extension to file Plaintiff's First Amended Complaint ("FAC"), currently required to be filed by September 12, 2016, and a one-week continuance of the scheduling conference, currently set for September 26, 2016 ("Application"). Although Counsel filed her Application the same day the FAC was due under the Court's August 26, 2016 order and although Counsel failed to lodge a proposed order consistent with this Court's Initial Standing Order and Local Rules, the Court finds good cause to afford Plaintiff an additional week to file her FAC in light of Counsel's averred injury.
