The Court is aware that the Presentence Report ("PSR") computes the Base Offense Level in this case implicitly concluding that Defendant has no convictions for "crimes of violence." The Court is also aware that the Probation Office is currently taking a second look at that issue (crime of violence). In order to afford the parties the best opportunity to be heard with respect to the crime of violence issue, regardless of what conclusion is reached by the Probation Office, the Court directs that each side file a brief (not to exceed 10 pages) discussing whether the offenses listed in paragraphs 28 and 30 are crimes of violence within the meaning of the Guideline. As such brief is not dependent upon the outcome reached by the Probation Office it shall be filed no later than 10 days prior to the sentencing date. SO ORDERED by Judge Raymond P. Moore on 6/1/2022.
