ORDER: Magistrate status hearing held. Discussion held regarding issues raised in joint status report, including reinsurance, which the Court considers closed as far as any discovery needs, and deposition scheduling. ORDER: Magistrate status hearing held. Discussion held regarding discovery related to Boeing's insurance. Boeing to provide Plaintiff with a list of Boeing's reinsurers with the A.M. Best ratings, if available, by 5/15/25. From the Court's perspective, discovery regarding the issue of Boeing's insurance and a hypothetical bankruptcy is now complete. Discussion held regarding upcoming mediation, depositions scheduled for 5/15/25 and 5/16/25, and an amended complaint. Court will reach out to the District Court about the timing and manner of filing an amended complaint, or motion to file an amended complaint. Discussion held regarding identification of witnesses to be called at trial. The Court is not aware of a Federal Rule of Civil Procedure requiring identification of trial witnesses (i.e. those witnesses who will actually be called at trial) during the general discovery process. Compare Fed. R. Civ. P. 26(a)(1) (requiring disclosure of individuals with knowledge, but not requiring disclosure of who may be called a trial); Boeing may file a motion, if it deems it necessary. Discussion held regarding burden on non-Boeing defendants participating in additional depositions, beyond those taking place on 5/15/25 and 5/16/25, should an amended complaint be filed. While the Court acknowledges this issue under Fed. R. Civ. P. 1 and 26(b), this general issue will be clarified when the district court resolves the issue of amending any complaint. Parties may file an agreed motion (or otherwise) to request additional depositions over the ten allowed as of right by Federal Rules of Civil Procedure 30(a)(2)(A)(i). Discussion held regarding status of written discovery. Parties shall meet and confer and any motion regarding Boeing's supplemental written damages discovery to be filed by 6/6/25. Boeing to respond to Plaintiff's recent discovery requests, which were re-served on Boeing after their initial service on 3/21/25 was not received by Boeing, by the date provided under the Federal Rules of Civil Procedure. As to Defendants Forkner and United States, counsel indicates that they anticipate the dismissal of these two defendants after a hearing in the Chandra case on 5/2/25. Status hearing set for 6/17/25 at 3:00 p.m., which may be stricken based on the status of the case. (PLEASE NOTE TIME CHANGE.) Parties may appear telephonically. Joint status report due by COB 6/12/25 as to the general status of the issues discussed herein and any other issues the parties wish to raise. Parties may appear in person or dial in using the Court's conference call in number. The conference call-in number is 1-855-244-8681 and the access code is 2316 422 1828##. ORDER: Magistrate status hearing held. Discussion held regarding admissions of liability and the scope of discovery. Parties to confer with clients as to two potential options for Boeing's admissions: 1) Boeing's admitting full liability in this case and covering 100% of damages in this case, or 2) Boeing's admission that it was the sole and proximate cause of the accident leading to this litigation.
