    MEMORANDUM-DECISION AND ORDER: It is hereby ORDERED that Defendants' motion to dismiss (Dkt. No. 12 ) is GRANTED in part and DENIED in part. It is further ORDERED that, as described in this decision, the First Cause of Action alleging FHA discr imination with respect to the Special Permit, is dismissed as to the City, ZBA, Planning Board, and the individual Defendants in their official capacities. It is further ORDERED that Chestnut Hill NY, Inc.'s remaining claims for injunctive and d eclaratory relief are DISMISSED pursuant to Younger. It is further ORDERED that Chestnut Hill NY, Inc.'s claims for monetary relief are STAYED pursuant to Younger. It is further ORDERED that Plaintiffs' claims under the New York State Const itution are DISMISSED without prejudice. It is further ORDERED that Defendants' motion to dismiss (Dkt. No. 12 ) is otherwise DENIED. It is further ORDERED that Defendants are granted leave to file a renewed motion to dismiss regarding the issu es the Court identified in this Order, including preclusion issues and the impact of Younger, if any on the individual Plaintiffs' claims, and the impact of the State Court's January 6, 2026 decision. However, the parties are first directed to meet and confer and file a status report by April 3, 2026, addressing whether they are able to resolve any issues so as to avoid any unnecessary briefing. Any renewed motion to dismiss must be filed by April 20, 2026.
